

This is the document that has many of the Elected Public Officials pissed at me for exposing. Why? Because they
published the lie in the paper, that there was "No Contamination" that was a bogus claim. Don Zeilenga had the
information on the initial soil samples taken from the site before Joe Birkett had them. Joe Birkett found out when it
was published in the paper. It pays to have friends, as Environment Concerns, did the initial sampling. Patrick
Engineering took the samples after the weekend, and after all the dirt was removed and replaced by Harry Kuhn
Trucking, who were also doing the Phrase III construction project at the time of this even. Both EPA and USEPA
were under the impression that Joe Birkett was going to prosecute the case. Joe Birkett felt it more important to run
for Attorney General in 2002, so he sat on those indictments, that included Don Zeilenga and his old Transportation
Committee of 1987, when he headed the Highway Department. Now does anyone need a clue as to where all of the
Emergency Budget went too? That had close to 187 million dollars in it, held for emergencies. Probably not much
left, except for a paper clip after this corruption was buried deeper than the striper actually was. That was about 20
feet! That was a lot of dust that covered this machinery up over an 11 year period. Those that live in the area, and
drink well water, think about this the next time you raise a cold glass of water on a hot day. This was lead-base paint
and a combination of Xylene, a combustible flammable solvent. Drink to your health, your Government is taking care
of you. Your County Board is watching out for you!
The reason I am exposing this corruption, is what the County did to me; more corruption. In short they hired two
corrupted lawyers from across the street, dangling money in front of them. Not hard to persuade these types to play
along! These two clowns submitted a forged "Winter Work Requirements" in Federal Court in Chicago in an ADA
violation I filed. I was dismissed while under a doctors work restriction. This was the aftermath of being harassed
after the union push of August 1998 that lost by about 7 votes. My concern was the coercion of these types of
documents used by management to intimidate employees, to show they were in control. This is the mentality of the
management there at Highway. I suppose neither management nor Personnel never heard of THE FAIR LABOR
STANDARDS ACT. Not from where I sat! They hid this document mostly from me. I had a glance at the
Administrative hearing, and never saw it again until I had to finally file a complaint against my attorney who took over
this case in January 2001. It took me 6 months and a complaint filed with ARDC in order to retrieve the documents.
That is when I discovered that the Highway Management photocopied a signature page from possibly, a 1991
document and attached it to this 1995 document. It still had Don Zeilenga's name on the signature sheet, so this
proves the page was signed under Don Zeilenga. Don Zeilenga was the County Administrator, in 1995 and when
this was signed. When he left, it made all Departmental Requirements null and void. I signed no others, as in May
1995, I had my first heart attack. I would not have signed this, as I objected when I signed the last one in 1991. I
was strong-armed by Carl Schweizer and would not allowed to leave until I signed this page. Now you know why I
favored a union.

This document was discovered at the time I retrieved my files in July 2002. I wrote the County Board Chairman with
complaints and also with this document. He turned the matter over to the Civil Division of the DuPage County States
Attorney's Office. The last time I heard, I thought forgery was Criminal! Yet the Chief of the Civil Division, Nancy
Wolfe, wrote in response to my complaint. Joe Birkett's "Obstruction of Justice" is nothing new here.

There have been a number of "Items" you consider corruption within the County, and has gotten worse, as the
Elected Public Officials seem to feel they are above the law. A lot of incidents surrounded the Highway Department,
as that is how, and where Zeilenga gained his power. Jack T. Knuepfer appointed Don Zeilenga to Highway, for the
sole purpose to bust up the union back in the 80's. Big secret meeting in the basement of the Administration
Building, when he also appointed Jack Tenison to Personnel. They were both Committeemen in their precincts!
Nothing Political here! Tenison is the biggest joke of all. Has a masters degree in Human Resources, and in
Business Administration. Go and check out how screwed up, he had Naperville, before coming to the County. They
cheered when he left. He had the place so screwed up was the comment made to me. Now he was appointed by
Zeilenga about 2000 to run the Airport Authority at a 150,000 salary I hear. That was most likely a $50,000 salary
increase. Another example of taking care of his friends, though they were at odds most of the time. Couldn't have
been the fulfilled promise for going along with what was instrumental of what they did to me. Zeilenga was asked to
leave in 2003 after only 23 years. The man was the "King of Corruption." Highway was the tool he had use to
hand out favors whenever anyone needed the labor force. Handing out election fliers, replacing a driveway skirt or
even putting in a new culvert, usually at Board Member's request, and sometimes at their own residence. I heard
some say they felt it was part of their benefits package. Then, some got free firewood "delivered," by the labor force
of Highway. Most residents would not get any benefits of this type unless they paid for it themselves!
Zeilenga got his fair share of tree and shrub trimming around his home and even wood chips. On the days the tree
crew was supposedly off, they worked all day on County time. Zeilenga and Galto devised the "BID RIGGING" with
regards to the County Equipment that probably still goes on. It was easily done as Ford, for instance would fax the
specs out to Galto, and he would spec the new trucks exactly as what information he obtained. Galto was not bright
enough to spec a vehicle, and had no real clue, however purchasing allow him to do it. These trucks have a GVWR
of 56,000 pounds and fully loaded, most weight out just under 69,000 pounds. From an engineering standpoint, you
wonder the wear on brakes, tires, and having to replace springs during the plow season. The mechanics see the
vehicles every 3000 miles for periodic maintenance, unless a driver gets a clue that he needs his brakes adjusted.
Most don't have a clue! In fact one takes medication for a form of narcolepsy. So political hires are a plenty at
DuPage also. Then, they could wind up like Formento's Son and son-in-law and allowed to quit as they couldn't
pass the CDL drug screening. No Nepotism here!
DuPage County Corruption
I notified EPA some time ago and told them there were more contaminates buried behind the highway
garage and they completely ignored it. Just as they ignored the striper until it was finally unearthed in 1998,
by the Phrase III construction project. The backhoe operator broke his windshield and the County gave him
a hard time about paying to replace it. That's how it all came about. Harry Kuhn Construction. The also
did the clean-up on the following Saturday replacing the dirt while both EPA and USEPA were on site for
technical assistance. The EPA allows Government entities to police themselves, and ignore complaints.

Welcome to my Home Page. This website is intended to humiliate DuPage County Board Officials and Joe Birkett as he played a
part in protecting the Board Officials when this occurred in 1999. The events are very true and the people named are actual
participants of the crime that was dismissed by the States Attorney's Office. This was my only recourse following the corruption
that when up clear to Federal Senior Judge Paul E. Plunkett's court Room and how they were able to duped this idiot and win the
argument that dismissed me from my employment from the DuPage County Highway Department of 12 years. (1987-1999)
This story starts out in the spring of 1998. There was a movement for Union representation from Local 150, International
Union of Operating Engineer's, out of Countryside, Illinois. Being represented by the Personnel Department with either Patty
Merola, or Cara Perone, who at present is the Personnel Manager. I leave it to you how she was able to be appointed to that
position, and it wasn't for her expertise or knowledge of the position. Of Course the correspondence between the Highway
Department and Personnel were well known by most; meaning any complaints given to personnel James Galto who managed the
Maintenance Department would have knowledge about the complaints before that individual employee hit the front door of the
Administration Building at the Jack T. Knuepfer Admin Bldg., 421 N. County Farm Road, Wheaton, IL 60187. Some say that she
was in Galto's pocket as they were both friendly to the Highway Supervisors and vice versa. The other supervisor was Carl
Schweizer, who took over as Manager after Arnie Kormoric retired.
James Galto wasn't what you would call a manager, as his style of managing the men was through Intimidation and coercion.
Anytime the need arose, such as having all available for plowing, he had used his power or abuse of his position to intimidate
everyone by locking everyone in the Sign Shop and having everyone sign what was called a "Winter Work Requirement." We will
discuss this form lately as this was the County's argument for Over-time. This was why I thought union representation would be a
good ideal and probably still goes on from the last I heard. Galto was known as the Big, Round, Mound, of Sound. Truer words
could not describe him better. I heard him from time to time rant and rave from his office upstairs. In fact a Todd from Personnel
interviewed everyone at Highway when Chuck Tokarski took the Reigns from Don Zeilenga in 1995. The findings of the problems
were in a report giving to Don Zeilenga after about 6 months. It named Galto as the biggest number one problem with the morale
in the Department. Zeilenga ordered the notes destroyed, but before that could be accomplish, the States Attorney's Office had
subpoenaed these as part of their Investigation.
The union push wasn't the only item taking place in the Spring & Summer of 1998. Galto being the Asshole he was and how
he treated his Crew leader's was also being investigated for corruption. The Investigation also included the subject of an old 1987
buried Paint Striper, but the Investigation started after someone wrote an anonymous letter to EPA. This was not the reason Galto
was dismissed, there was also allegations of theft in which he had the County pay for some of his race car parts and some Amsoil
Synthetic Transmission Fluid. Two 55-gal drums he kept under lock and key under the sign shop where they housed the warning
lights. He would tap the fluids when he planned to change the oil on his race/show car he had his two favorite Mechanics, Chuck
Curcio and John Howard Casale. The two biggest such asses. Of course that all changed after they got special promotions after
finishing the car. Then the next suck-ass took over. David Ricker, a yard tree mechanic who told Galto he would go back to Milton
Township if he didn't get the next Crew Leader position. Apparently that worked! There was so much of that in the shop, it was
unbelievable.
The Union vote was around August 25, 1998. The vote was 7 votes short for approval. Way too many idiot's who couldn't
part with a few dollars and couldn't figure out the union would have been a better choice. It wasn't too long afterwards that Galto
and Schweizer orchestrated harassing me as Galto was indicted and was on his way out the door for his theft. That was a real
joke, as he could have taken all Board Members out that he did favors for, so pleading guilty to a misdeamnor theft of $300. The
Amsoil alone with a case of performance saver would total close to $3000.00. This got him no jail time, half of his $73000.00
salary for a severance pay and he got to keep his full retirement benefits. Only at the County. Don Zeilenga was scared as he did
many favors for him and his friends. Zeilenga was responsible for scrapping the old striper. He had his Transportation Committee
vote in favor, so the indictment's initially were Zeilenga and his 7 County Board Members that were involved in 1987, on the
Transportation Committee. One was Carol Pankau who is now a State Senator. These people think they are above the Law and
can use you tax dollars at their discretions. The reason Galto got this famous deal was the fear he could have taken half the
Board Members out. He keep records on everything he did. It didn't save his job, but it did get him a sweet deal. He shortly
worked for the Management Consultants that lasted less than a month as it took them that long to find out he had no business in
any management. The last I heard he used his Political connections to obtain a job at the Tollway in Downers Grove. I guess he
will shoot for number 4, as including the County, he had been fired from for stealing. This is the problem with Appointees at the
County; knowing absolutely nothing about the Job Description, but they know someone high up the food chain that someone owes
a favor to. Now you know how and why the County is so screwed up.
The States Attorney's Office was going to cut Galto loose, up until the old striper was unearthed, just days before the union
vote. As I stated the striper business was that of Don Zeilenga's Transportation Committee. Galto's only involvement was the
misconduct of following order from Zeilenga and he ordered Galto to cut it up. So like a good soldier, Galto had his "A Team"
members, or the weekend warriors they were called were busy on the weekend back in 1987 cutting it up in order to scrap it.
Unfortunately, the striper caught fore after the mechanics warned them about the danger of the highly flammable solvent they used
to flush the paint lines. This is also a hazardous chemical called Xylene. That is how this 20 foot Machine ended up 20 foot deep
in the back yard of the Highway Department. So even at 12 years of dust would not accumulate or amount to being buried at 20
feet below the surface, so perhaps Don Zeilega should have taken a refresher math course. Zeilenga arrived on the science when
the Construction workers, working on a phraseIII project unearthed the machine. Unexpectedly, it had broken the windshield of the
large backhoe. Then while planning to bury this deeper than it was, the States Attorney was tipped off by an anonymous caller. It
was soon after that I was targeted for harassment. The remainder of the Striper is posted on my other page, Birkett Corruption.
You have to read this page if you think Joe Birkett really will protect the rights of the taxpayers, and deserving of higher office. I
would appreciate anyone who reads this to refer everyone you know and direct them to read this site.
The start of the harassment was the following day after they found the striper. I came out at lunch time to my truck and found
the news article about the striper. You can view it for yourself (Photo.html) and figure out if you feel this the mentality of one that
would be of a mature managerial, as most of this was all being orchestrated by Galto and then his second in command Carl
Schweizer. My union hat disappeared shortly thereafter. Not really a big deal. The day we were suppose to vote for the union, I
came back to my tool box to get my flashlight and found my hat stuff in the drawer. It had gone through the wood chipper before it
was returned. I immediately saw Morgan Cotton and reported it to him and he couldn't help from laughing about it. He had the
second set of keys to my tool box. He came from the Tollway, resigning just days before he was about to get indicted. Gale
Franzen was still Chairman and had created a classification for him as Deputy Chief under Chuck Tokarski. The culprits were
Dave Ricker I was sure and according to a witness Dave had bragged about doing this, along with his buddy Tony. Nothing like
being intimidated on the day we were suppose to vote for the union. This just confirmed why I felt a union was a better choice.
Other incidents, were candy that was chewed up and spit on the top of my tool box. That was discussing! My personal truck was
damaged with passenger side tail and turn signals, both front and back kicked and cracked. Then the door panel kicked in and
electric windows would no longer work. Then one night I walk out the parts side to keep my truck from further damage. Ricker was
loading up used County tires and walked out to find duck feces smeared on the front and passenger side window. Rather obvious
who had done the deed.
So anytime Carl could haul me across the street to Patty Merola in Personal and write me up he took advantage of it. I was
ordered to change a flat tire on a patch wagon one morning when it was 20 below. Mind you My heart attacked was in 1995, and
extreme cold can do major harm to my arteries and stent. So I slowly drove the patch wagon into the bay where I could make
essential repairs, only to find Carl standing at the parts counter and it was visible he could see the tire seal had broken. After
making his way down and confronted me by saying I can not believe you did that, and my only response was, "I didn't want to
disappoint you Carl." Needless to say we made another trip to Personnel and saw Patty where I was also written up for swearing
when I told Carl in front of Patty, that "I was tried of his Fucking games."
